1. The learned advocate after making some submission states that he has now obtained a fitness certificate in terms of the impugned order dated 21.01.2026 passed by the learned Judge-in- Charge, Nazarat Department, Rampurhat, Birbhum and therefore, he does not want to proceed with this matter.
2. In view of such submission, the writ petition is permitted to be withdrawn.
3. Accordingly, the writ petition is disposed of as withdrawn.
4. Since the self-same order dated 21.01.2026 was the order impugned before the West Bengal Administrative Tribunal (‘Tribunal’ for short), also now nothing would survive in the Original Application also.
5. Therefore, the Original Application bearing O.A. No. 53 of 2026 pending before the Tribunal also stands disposed of in terms of the present order.
6. We make it clear that we have not expressed any opinion in the merits of the petitioner’s claim, dependent upon submission of certificate of fitness, which is to be considered by the appropriate authority in accordance with law.
