THE HONOURABLE SRI JUSTICE D RAMESH AND THE HONOURABLE SRI JUSTICE ALAPATI GIRIDHAR
The Court made the following Common Order:

These Appeals are filed by the Uranium Corporation of India Limited, a Government of India Enterprise, aggrieved by a Common Order in a batch of Writ Petitions vide W.P.No.23997, 23938 & 24407 of 2020.
These Writ Petitions are filed with common relief, hence the relief sought in W.P.No.23997 of 2020 is extracted hereunder:
“… to issue an order or direction more particularly one in the nature of writ of MANDAMUS by holding that the action of the respondents in not considering the case of the petitioners for re fixation of the Pay by rectifying the pay anomaly as capricious violative of Article 14 of the Constitution of India contrary to F R 22 (1a) I R/w Rule 13 of CCS RP Rules 2016 and as such liable to be set aside in the interest of justice with a consequential direction to the respondents to directing to consider the case of all the petitioners for refixation of the Pay by rectifying the pay anomaly with all the consequential benefits and to pay the arrears of difference of salary from the date of pay anomalous introduced forthwith and pass…”
After considering the matter in detail, the Writ Petitions were disposed of by a learned Single Judge vide Common Order with the following directions:
“18. Accordingly, all the Writ Petitions are disposed of. The respondents are directed to consider the case of the petitioners from the date of Revision of pay scales in the year 2018 and pass appropriate reasoned orders in accordance with respective Rules within a period of three (03) months from the date of receipt of a copy of this order. There shall be no order as to costs.”
Learned Senior Counsel appearing on behalf of the appellants submitted that the impugned order is not only beyond the scope of the prayer

made by the petitioners in the Writ Petitions, but is also contrary to law. It was specifically contended that it was not the case of either party that the pay scales were revised or reviewed pursuant to a revision of pay scales in the year 2018.
In fact, the Corporation had revised the pay scales in the year 2018 only in respect of the Workmen category. No revision had taken place with regard to the Officer cadre to which the petitioners belong and who are working on the administrative side. Therefore, the direction in the impugned
order is contrary to law.
Learned Senior Counsel further submitted that the grievance of the respondents/petitioners was with regard to non-fixation of pay in terms of F.R.
22. However, the Court, without such a basis, granted a direction to consider and re-fix the pay scales from the year 2018, as if a revision had taken place in that year. He also further placed reliance on the Orders passed by the Appellants on 23.11.2024. Pursuant to the disposal of Writ Petitions, the respondent authorities have not considered the case of the petitioners with effect from 2018, for the reason that there was no revision of pay in respect of the Officer cadre in the year 2018.
Learned Counsel for the respondents/petitioners submitted that the grievance of the petitioners is that despite a pay anomaly, as the petitioners were appointed during 2010–2011 and some persons appointed along with them are drawing higher salary, the matter was brought to the notice of the authorities for re-fixation of salary and removal of the anomaly. However, the respondents failed to consider the said request, which led to the filing of the present appeals.
As far as the revision of pay in 2018 is concerned, the learned counsel for the respondents also could not place any record to show that any revision had taken place in respect of the Officer cadre.
Having considered the submissions and perused the record, this Court is of the view that the impugned Common Order is liable to be set aside.

Learned Senior Counsel also fairly conceded to withdrawn the Order dated
23.11.2024. In view of the above, both the impugned Common Order as well as the order dated 23.11.2024 are set aside, with a direction to the respondent authorities to consider the case of the respondents/petitioners. The respondents/petitioners are granted liberty to submit a fresh representation/application along with all relevant material. If any such application or material is submitted within two (02) weeks from the date of receipt of this Order, the authorities concerned are directed to consider the same and, if any pay difference or parity is found, the same shall be rectified and consequential benefits shall be paid to the petitioners within a period of four (04) weeks thereafter.
Accordingly, the Writ Appeals are disposed of. No order as to costs.
Consequently, miscellaneous petitions, if any, pending shall stand closed.
