No.12527 of 2026 Sections 118(1) of BNS Act, 2023, and Section 75 of Juvenile Justice (Care and Protection of Children) Act, 2015, in Crime No.25 of 2026, on the file of the respondent police seek anticipatory bail. 2. The petitioners herein are mother and the father of the victim child, who is aged about 3 years. The allegation against the petitioners is that they subjected the child to continuous physical cruelty, causing various injuries and trauma. After intervention by the Child Welfare Committee, the said incident came to light, and the medical records of the child reveal multiple injuries of different natures, which could not have been done by the normal parent. Hence, the case has been registered. 3. The learned counsel for the petitioners submitted that the petitioners are innocent and they have not committed any such offence as alleged by the prosecution and they have been falsely implicated in this case. He further submitted that they are the natural guardians of the child and they provided treatment for the child, and the injuries occurred due to accidental fall, and that they are ready to co-operate with the 2/5 https://www.mhc.tn.gov.in/judis CRL OP(MD). No.12527 of 2026 investigation. Hence, he prayed to grant anticipatory bail to the petitioners. 4. The learned Counsel For State of TN (Crl.Side) appearing for the respondent police reiterated the prosecution case and on instructions, submitted that the medical records reveal a disturbing pattern of injuries caused to the child and granting anticipatory bail to the petitioners would affect the investigation and the investigation is at preliminary stage. Hence, he opposed to grant anticipatory bail to the petitioners. 5. I have gone through the FIR and accident register and medical records. The materials revealed that the victim child was subjected to physical assault on several occasions. 6. Considering the nature of injuries caused to the child and the investigation in this case is in preliminary stage, and granting anticipatory bail would hamper the investigation, this Court is not inclined to grant anticipatory bail to the petitioners. 3/5 https://www.mhc.tn.gov.in/judis CRL OP(MD).
