Case No. 99 of 2025 for the offence registered under Sections 305, 331(4) of Bhartiya Nyaya Sanhita, 2023 pending in the Court of learned Additional Chief Judicial Magistrate, Bermo at Tenughat, is pressed into motion. Petitioner is a goldsmith and the allegation against him is that he had purchased the stolen property from the co-accused, Ravi Kherwar, who has been granted bail by the co-ordinate Bench of this Court. It is submitted by the learned counsel on behalf of petitioner that the co-accused has been granted bail by the co-ordinate Bench of this Court and the allegation against him is that stolen articles i.e. gold and silver ornaments were seized from this petitioner. It is contended that these stolen articles were not put on TIP. Learned A.P.P. opposed the bail petition. It is submitted that stolen gold locket was seized from this petitioner and he has also criminal antecedent of similar nature being Gola P.S. Case No.135 of 2024 which is suggestive of the fact that he is habitually dealing with stolen property. Under the circumstances, this Court is not inclined to enlarge the petitioner on bail.
