JUSTICE RAJESH SHANKAR For the Petitioner : Mr. Rahul Ranjan, Advocate For the State : Mrs. Lily Sahay, A.P.P. 02/20.02.2026 The petitioner is an accused for the offences punishable under Sections 112(2)(b)/ 317(2)/ 317(5)/ 318(4)/ 319(2)/ 336(3)/ 338/340(2)/3(5) of the Bharatiya Nyaya Sanhita, 2023, Section 66(b)/66(c)/66(d) of the I.T. Act and Section 42(3)(e) of the Telecommunication Act, 2023. 2. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case and has not committed any offence as alleged in the F.I.R. It is further submitted that similarly situated co-accused persons namely Janab Ansari and Sanfaraj Ansari have already been granted regular bail by a co-ordinate Bench of this Court vide orders dated 20.02.2026 passed in B.A. No. 271 of 2026 and B.A. No. 283 of 2026 respectively. The petitioner has no criminal antecedent as has been stated in paragraph-22 of the present bail application. He is in judicial custody in connection with the present case since 19.11.2025 and hence, he may be given the privilege of regular bail. 3. Mrs. Lily Sahay, learned A.P.P. though opposes the petitioner’s prayer for regular bail on merit, however she fairly accepts that the aforesaid co-accused persons, who have already 2026:JHHC:5175 - 2 - been granted regular bail by a co-ordinate Bench of this Court, are similarly situated to the petitioner. 4. Having heard learned counsel for the parties and considering the materials available on record, I am inclined to enlarge the petitioner on bail. 5. Accordingly, the petitioner above named is directed to be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of like amount each to the satisfaction of learned Special Judge, Cyber Crime, Jamtara in connection with Jamtara Cyber Crime P.S.
