Sharma for the petitioner Deepak Kumar Singh who has filed this application under Section 528 of BNSS 2023, for quashing and setting aside the impugned orders dated 09.02.2026 and 20.03.2026 and consequent orders passed thereon by the learned Chief Judicial Magistrate, Dima Hasao, Haflong in PRC case No.144/2024 arising out of Haflong PS case Page No.# 2/2 No.47/2022. The petitioner is booked under Section 120B/420 of the IPC. 2. Heard Mr. B. Sharma, learned Addl.Public Prosecutor for the State respondent who has raised objection against the prayer for quashing and setting aside the aforementioned orders. 3. The learned counsel for the petitioner has drawn the attention of this Court to the Annexure- 1 series which reflects the order dated 09.02.2026. The order depicts that several summons have been issued to the petitioner for a year and thereafter, the court issued NBWA. On his absence on 20.03.2026, the Court passed an order issuing NBWA and P & A against the petitioner. The petitioner is willing to appear before the trial Court and co-operate with the proceedings. 4. I have taken a pragmatic view. As the petitioner is willing to appear before the learned trial court and co-operate with the proceedings, it is provided that the petitioner shall appear before the learned trial Court within 15 (fifteen) days from today and till his appearance, the execution of the NBWA and P&A issued against him shall be kept in abeyance subject to the condition that if he fails to appear within the specified period, on the 16th day, this order shall automatically come to an end. 5.
