Learned counsel for appellant submits that though respondents/writ petitioners sought a direction to police authorities to desist from interfering in a 2 HCJ & CGR, J W.A. No: 448 of 2026 civil dispute, in effect they tried to establish their possession over the property in question in an illegal manner. Writ petitioners, it is submitted, portrayed that they are in possession of property, whereas it is the appellant who is in possession thereof. W.P. No.37162 of 2022 has been filed by appellant against them qua the same property. It is further submitted that Writ Petition Nos.21510 & 21508 of 2022, 19132 to 19137 of 2024 and 7247, 21109, 21121, 21124 & 21136 of 2025 pending adjudication before this Court, also relate to property in question. 3. Learned counsel for appellant submits that impugned order has been passed in limine without issuing notice to present appellant, who is arrayed as respondent No.6 in writ petition and that impugned order has been passed on the assumption that writ petitioners are in peaceful possession of property. Thus, causing grave prejudice to appellant, who has not been heard. In case notice had been issued to appellant, the factum of entire pending litigation would have been brought to notice of learned writ Court to dispel the impression that it is only W.P. No.20626 of 2023 filed by writ petitioners which is pending adjudication. 4. Learned counsel for respondents/writ petitioners, while opposing this appeal, is however unable to deny that there are a number of writ petitions pertaining to subject property, which are still pending adjudication. 3 HCJ & CGR, J W.A. No: 448 of 2026 5. Keeping in view facts and circumstances as noted above, it is considered expedient that learned writ Court should be appraised of entire facts and circumstances and matter decided afresh, after considering the entire factual gamut. Impugned order, dated 06.03.2026, is thus set aside and matter remanded to learned writ Court to be decided afresh in accordance with law. Registry is directed to list W.P.No.5664 of 2026 on 22.07.2026 before appropriate Bench having Roster. Writ Appeal is accordingly disposed of. No costs. Pending miscellaneous applications, if any, shall stand closed.
