ORDER This writ petition has been filed seeking for a direction to the respondents 1 and 2 to consider the petitioner's representation, dated 09.06.2026 and to take appropriate action. 2. The learned counsel for the petitioner submitted that the petitioner is a practicing Advocate before the District Court of Madurai and before this Court. On 04.02.2026, during a Field inspection conducted by the Revenue and Police officials, along with News Reporters, the petitioner was targeted by one Ayyanar, his wife Muthu and his son Ajithkumar. The petitioner was abused with the filthy language and also attacked by them. The police officials on the spot remained passive spectators and did not take any steps to stop the attack. In this regard, a complaint was lodged by the petitioner before the Inspector of Police, Krishnan Kovil. However, no case was registered against the said accused persons. In the interregnum, based on the complaint of one Muthu, wife of Ayyanar FIR has been registered against the petitioner in Cr.No.37 of 2026. 2/6 https://www.mhc.tn.gov.in/judis
W.P.Crl.(MD)No.3918 of 2026 3.The learned counsel further submitted that since no action was taken against the petitioner's complaint, the petitioner filed a writ petition before this Court in WP(MD) No.1409 of 2026, dated 12.03.2026 directing the Deputy Superintendent of Police, to conduct a fair and impartial investigation. On 12.03.2026, this Court directed the Deputy Superintendent of Police to conduct fair and impartial investigation in Cr.Nos.36 and 37 of 2026 and conclude the investigation within a period of two moths. However, without conducting proper investigation, in a hasty manner the Deputy Superintendent of Police has concluded the investigation and filed charge sheets in both the Crime Numbers before the Judicial Magistrate No.II, Srivilliputhur. In this regard, the petitioner has sent a representation on 09.06.2036 and the same was not considered. Hence, this petition. 4. The learned Government Advocate (Crl.Side) appearing for the respondents submitted that the respondents police have completed the investigation in Cr.Nos.36 and 37 of 2026 and filed final report before the Judicial Magistrate No.II, Srivilliputhur. In Cr.No.36 of 2026, charge sheet was numbered as CC No.48 of 2026 and in Cr.No.37 of 2026, charge sheet was not yet numbered. 3/6 https://www.mhc.tn.gov.in/judis
W.P.Crl.(MD)No.3918 of 2026
5. Heard the learned counsel on either side and carefully perused the materials before this Court.
6.It is seen that already the investigation has been concluded by the Deputy Superintendent of Police, Srivilliputhur, and the investigation in both the FIR in Cr.Nos.36 and 37 of 2026 have culminated in laying charge sheets. However, as rightly pointed out by the learned counsel for the petitioner, without identifying the aggressor in a complaint and counter complaint, charge sheets have been filed in both the cases is violation of mandates of T. Balaji v. State reported in 2024 (2) L.W. (Crl.) 175 . Hence, it is a considered opinion of this Court that the way out for the petitioner is to challenge the aforesaid charge sheets in the manner known to law. 6.With such observations, this writ petition is disposed of. 16.07.2026 NCC : Yes / No Index : Yes / No PNM 4/6 https://www.mhc.tn.gov.in/judis
