Ms. Pushpa Joshi, learned senior counsel for the Applicant. 2. Mr. Pradeep Lohani, learned AGA for the State of Uttarakhand. 3. In the High Court of Uttarakhand, the present case arises from Bail Application filed under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023, seeking regular bail for the Applicant - Lokpal, who has been accused in FIR No.22 of 2026, punishable under Sections 110 and 3 (5) of BNS, 2023, at Police Station Kathgodam, District Nainital. 4. The case of the prosecution is that on 27.02.2026, at about 11:15 PM, the son of the Complainant – Lokesh Singh Dhami, was allegedly assaulted near “Chambal Bridge” by the accused persons including Vijay Mehra along with others, by means of a sharp edged weapon, causing injuries on his neck, with an alleged intention to kill, and he is stated to be undergoing treatment at Chandan Hospital. Therefore, the FIR has been lodged against the accused persons by the Complainant. 5. According to the prosecution, the accused and co- accused premeditated the attack on the victim, and during the altercation, accused Vijay Mehra fatally stabbed the injured Lokesh Dhami in the neck. The accused action falls under Section 110 of the Indian Penal Code, which amounts to
attempt to commit culpable homicide not amounting to murder. 6. Learned counsel for the Applicant submits that the Applicant has been falsely implicated in the present case. He further submits that the Applicant has no previous criminal history. 7. The bail application of the Applicant has been vehemently opposed by the learned State Counsel. 8. Considering the overall facts and circumstances of the case, the Applicant has made out a case for bail. 9. Accordingly, bail application is allowed.
It is directed that the Applicant - Lokpal, who has been accused in FIR No.22 of 2026, punishable under Sections 110 and 3 (5) of BNS, 2023, at Police Station Kathgodam, District Nainital, be released on bail on furnishing a personal bond with two reliable sureties each in the like amount to the satisfaction of the concerned court. The Applicant shall cooperate with the trial proceedings and shall not misuse the liberty granted to him. ( Ash ish Nait h an i, J.)
