THIS WRIT PETITION COMING ON FOR PRELIMINARY HEARING IN ‘B’ GROUP THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: THE HON'BLE MRS JUSTICE K.S.HEMALEKHA - 3 - HC-KAR NC: 2026:KHC-D:186 WP No. 106916 of 2014 ORAL ORDER The petitioners have approached this court calling in question the orders passed by the Assistant Commissioner and the Deputy Commissioner under the Provisions of Karnataka Land Revenue Act, 1964 (for short ‘the Act’). The proceedings arose out of mutation entries relating to the subject agricultural lands. 2. The record would disclose that respondent No.1 initially approached the Tahsildar seeking entry of her name in the revenue records. The said order of the Tahsildar was carried in appeal by respondent No.1 before the Assistant Commissioner under Section 136(2) of the Act. 3. The Assistant Commissioner set-aside the order of the Tahasildar. Aggrieved thereby, the petitioners’ preferred Revision before the Deputy Commissioner under Section 136(3) of the Act, which came to be rejected giving raise to the present the writ petition. - 4 - HC-KAR NC: 2026:KHC-D:186 WP No. 106916 of 2014 4. It is not in dispute that the question relating to right, title and interest over the subject land is pending adjudication before this Court in RSA No.100904 of 2018. 5. In light of the pendency of the Civil dispute, this Court is of the considered view that the revenue entries cannot attain finality. Accordingly, the writ petition is disposed of by clarifying that any mutation in the revenue records, shall be subject to the final outcome of RSA No.100904 of 2018.
