Petiitoner has filed this petition seeking following reliefs: “10.1 That, this Hon'ble Court may kindly be pleased to call for the entire records in relates to the case of the petitioner from the possession of respondents for its kind perusal. 2 / 3 10.2 That, this Hon'ble Court may kindly be pleased to direct the respondents to consider and decide the representations (Annnexure-P/5) of the petitioner for grant of posting elsewhere at Block Dharsiwa, District Raipur against the vacant post within stipulated period of 15 days. 10.3 That, this Hon'ble Court may kindly be pleased to grant any other relief/relief's in favour of the petitioners, which the Hon'ble Court deemed fit & just in the facts and circumstances of the case, including awarding of the costs to the petitioner.” 2. Learned counsel for petitioner submits that petitioner’s service was attached to the Government Primary School Baratnara, Block Dharsiva, however, taking into consideration the letter dated 24.06.2025 petitioner is relieved to join at the substantive place of posting. The order was challenged in writ petition bearing WPS No. 498 of 2026, which was dismissed , however, liberty was granted to the petitioner to submit fresh representation, for his posting in any other school where post is lying vacant. The representation submitted by the petitioner on 09.02.2026 was dismissed vide order dated 10.02.2026 without considering the grounds pleaded in the representation, and therefore, the order dated 10.02.2026 be set aside. 3. Counsel for the State opposes the submission and would submit that from the proceedings of the writ petition No. 498 of 2026, it is appearing that earlier the petitioner’s services were attached to Government Primary School Baratnara, Block: Dharsiva, however, according to the directives issued by the Joint Divisional Commissioner for cancelling all the orders of attachment, petitioner is directed to join the substantive place of posting in Government Primary School, Mana Basti, Block Dharsiwa, which cannot be said to be erroneous. District Education Officer, considering the aforementioned notification has rejected the representation directing the petitioner to join at the substantive place of posting, within a period of three days. 4. Taking into consideration the nature of grievance raised in particular, the writ petition filed by the petitioner earlier cancelling of the order of attachment and his posting at his substantive place of posting at Government Primary School, Mana Basti, Block Dharsiwa and further that the posting of an employee is within the exclusive domain of the employer, I do not find any good ground to interfere with the decision taken by the District Education Officer, Raipur vide Annexure-P/6.
