Page 3 of 5 2. Assailing the proceedings issued by the 2nd respondent vide Rc.No.1233/2024,CS, dated 06.06.2025 (Ex.P1), the above writ petition was filed. 3. By the impugned proceedings, the 2nd respondent terminated the temporary dealership of the petitioner in respect of F.P. Shop No.0181085 of Adityanagar Colony, Srikakula District. 4. An interim order was granted on 23.06.2025, suspending the operation of the proceedings impugned under Ex.P1. The order was complied with. 5. Pending the writ petition, the 2nd respondent again withdrew the dealership by another proceeding vide Rc.No.107/2026 CS, dated 24.04.2026, and the petitioner filed another W.P.No.18340 of 2026. In view of the said development, the cause in the present writ petition does not survive. 6. While parting with the writ petition, this Court intends to observe the following aspects. 7. As per Clause 8(4) of the Andhra Pradesh State Targeted Public Distribution System (Control) Order, 2018, the disciplinary case filed against the Fair Price Shop Dealer shall be disposed of, preferably within a period of three (03) months from the date of filing. Clause 8(5) outlines that the disciplinary or appointing authority shall make an alternative arrangement for the distribution of commodities. The appointment of a temporary dealer, as per the above provision, is up to a period of three months or till the appointment of a regular dealer for the fair price shop, whichever is earlier. 8. The 1st respondent, vide G.O.Ms.No.32, Consumer Affairs, Food and Civil Supplies (CS.I) Department, dated 03.12.2018, issued the guidelines for the selection and appointment of the Fair Price Shop Dealers under the Andhra Pradesh State Targeted Public Distribution System (Control) Order, 2018. As per the said G.O., all vacancies of Fair Price Shops shall be notified through print media on the 1st of every month by the Appointing Authority and applications will be invited from candidates for selection and appointment as Fair Price Shop Dealers. 9. This Court has noticed that in several cases, the appointing/disciplinary authorities are not adhering to Clause 8(5) of the A.P.S.T.P.D.S. (Control) Order, 2018 or G.O.Ms.No.32 Consumer Affairs, Food and Civil Supplies (CS.I) Department dated 03.12.2018, and are continuing the dealers appointed temporarily for an indefinite period. In fact, even in the appointment letters, the authorities do not mention the time of the temporary appointment. 10. Given the facts and circumstances of the case, this Court deems it appropriate to direct the learned 1st respondent to issue necessary instructions to the appointing/disciplinary authorities to adhere to the procedure prescribed under Clause 8(5) of the A.P.S.T.P.D.S. (Control) Order, 2018 and G.O.Ms.No.32, Consumer Affairs, Food and Civil Supplies (CS.I) Department, dated 03.12.2018, in respect of the appointment of temporary dealers and their continuation. 11. With the above observations, the writ petition is closed. There shall be no order as to costs. 12. The Registry is directed to forward a copy of this order to the learned Principal Secretary (Civil Supplies), the 1st respondent.
