The writ petition has been filed in the nature of Certiorarified Mandamus seeking to call for the records relating to the notice issued by the 3rd respondent/Tahsildar, Srivaikuntam, dated 17.02.2026 and to quash the same. 2.The above said notice had been issued under Section 6 of the Tamil Nadu Land Encroachment Act, 1905. Even before issuance of the said notice under Section 6, notice under Section 7 of the said Act would have been issued to the petitioner. At any rate, the petitioner has also availed the provision under Section 10 of the Act by filing an appeal before the District Collector. Additionally, the petitioner has also filed a suit seeking declaration of title, and the said suit is also pending in O.S. No.36 of 2026 before the Principal Sub Court, Srivaikuntam. The entire issue surrounds the alleged possession of the petitioner in the land 2/4 https://www.mhc.tn.gov.in/judis W.P.(MD)No.20225 of 2026 comprised in Survey No.330/8, measuring 0.07.51 hectares, at Murappanadu Kovilpattu Village, Srivaikuntam Taluk, Thoothukudi District. 3.We would only issue a direction to the first respondent/District Collector to pass appropriate orders in the appeal filed under Section 10 of the Tamil Nadu Land Encroachment Act by the petitioner, after following due procedure. At any rate, the said appeal shall be disposed of on or before 31.08.2026. Accordingly, this writ petition stands disposed of. No costs. Consequently, connected miscellaneous petition is closed.
