Present bail application is filed by the applicant, who is in judicial custody in connection with FIR No.0093 of 2025 under Section 65(2) of B.N.S. and under Section 5/6 of POCSO Act registered at P.S. Haldwani, District Nainital. 4. The FIR is lodged with the allegation that applicant forcibly sexually harassed the minor daughter (aged about 9 years) of the complainant. 5. Learned counsel for the applicant submits that applicant has falsely implicated in the present case; the prosecution story does not disclose any allegation of penetrative sexual assault and the medical of the victim has not been done by the doctors. He submits that applicant has been implicated due to previous enmity regarding money, which is given by the applicant to the complainant. He submits that applicant has no criminal history. 6. Learned State counsel vehemently opposed the bail application and submits that victim was at the tender age of 9 years at the time of incident who was subjected to rape by the applicant. He submits that the investigation officer has recorded the statement of the father of the victim, wife of accused Baby Goyal, who stated that present applicant is habitual of taking liquor and also he sexually harassed his own daughter (minor girl). He further submits that present accused/applicant has committed a very serious offence, hence he does not deserve bail. 7. Having heard the rival contention of the parties and after perusal of the record, this Court is of the view that it is a heinous crime which the present applicant has committed hence the bail application of the applicant deserves to be rejected.
