JUDGMENT (per Hon’ble Sri Justice D. Ramesh)
Heard the learned counsel for the appellant.
2. This Appeal is filed against the Judgment and Decree dated 30.06.2025 passed in D.O.P.No.174 of 2022 by the learned IX Additional District and Sessions Judge, Krishna, Machilipatnam. Whereby, the Court below allowed the D.O.P.No.174 of 2012 filed by the respondent/wife under section 32 of Indian Divorce Act, 1869 seeking restitution of conjugal rights. Aggrieved by the said Order, the husband/appellant has preferred the present Appeal.
3. While Appeal was pending, the parties have entered into a compromise on certain conditions. The learned counsel for the appellant has submitted the Agreement Deed across the Bar and requested to permit withdrawal of the Appeal.
4. Considering the submissions and on perusal of the Agreement Deed, the Appeal is dismissed as withdrawn. No order as to costs.
