No.13018 of 2026 Sections 296(b), 109, 115(2), 118(1) and 351(3) of BNS Act, 2023, in Crime No.209 of 2026, on the file of the respondent police seeks anticipatory bail. 2. The allegation against the petitioner is that due to property dispute, the petitioner attacked the defacto complainant and caused severe injury. Hence, the case has been registered. 3. The learned counsel for the petitioner submitted that the petitioner is innocent and he has not committed any such offence as alleged by the prosecution and he has been falsely implicated in this case. He further submitted that due to property dispute, this case has been registered against the petitioner and with regard to the property dispute, a suit in OS.No.102 of 2023 was filed by the petitioner and the same is pending and counter case has also been registered against the defacto complainant in Crime No.210 of 2026 and the petitioner is ready to co-operate with the investigation. Hence, he prayed to grant anticipatory bail to the petitioner. 4. The learned Counsel For State of TN (Crl.Side) appearing for the respondent police, reiterated the prosecution case, and on instructions, 2/4 https://www.mhc.tn.gov.in/judis CRL OP(MD). No.13018 of 2026 reported that the injured is still undergoing treatment and the investigation is at preliminary stage and counter case has also been registered against the defacto complainant in Crime No.210 of 2026. However, he opposed to grant anticipatory bail to the petitioner. 5. I have gone through the FIR and also the connected materials. 6.Considering the nature of allegations against the petitioner and also considering the fact that the injured is still undergoing treatment, this Court is not inclined to grant anticipatory bail to the petitioner. 7.
