HIGH COURT OF JUDICATURE AT ALLAHABAD MATTERS UNDER ARTICLE 227 No. - 12181 of 2026 Court No. - 9 HON'BLE ROHIT RANJAN AGARWAL, J.
1. This is plaintiffs' petition. In the suit filed by plaintiffs, an application for grant of temporary injunction was moved which was allowed by trial court against which State has preferred a delayed misc. civil appeal under Order XLIII Rule 1(r) CPC. In the said appeal, an application for condonation of delay under Section 5 of Limitation Act was filed which has been allowed by order impugned.
2. Learned counsel for petitioners, after some argument, states that appeal itself may be decided, as expeditiously as possible.
3. As no useful purpose would be served in keeping the matter pending, the writ petition is being disposed of, at the admission stage, without calling for counter affidavit or issuing notice to private respondents, with a direction upon court concerned to decide the misc. civil appeal filed under Order XLIII Rule 1(r) CPC by State, in accordance with law, after hearing all affected parties, preferably within a period of one month from the date of production of certified copy of this order.
4. With the aforesaid directions, writ petition stands disposed of.
5. It is made clear that this Court has not adjudicated the matter on merits. September 8, 2026 (V. S.
