The learned counsel for the petitioner submitted that the petitioner’s father had executed a registered Settlement Deed in favour of the petitioner and his brother, conveying agricultural lands situated in S.F. Nos. 526/1H, 526/1K3, 527/1I2, 527/1J2, 527/1K, 528/1F, and 528/1G, measuring a total extent of 74 ½ cents at Jertalav Revenue Village, Thimmampatty Village, Palacode Taluk, Dharmapuri District. It is submitted that the petitioner and his brother are in peaceful possession and enjoyment of the subject property, and the revenue records have also been duly mutated in their names.

3. To secure their holding, the petitioner submitted an application on 19.01.2026 before the second respondent seeking a survey and boundary demarcation of the property. Since the said application has not been considered by the respondent authorities to date, the petitioner has approached this Court by way of the present Writ Petition. 4. Mr.B.Pachaiyappan, learned Government’s Counsel, who accepts notice on behalf of the respondents 1 to 3 would submit that the petitioner’s land will be surveyed and demarcated based on his online application dated 19.01.2026 along with necessary police aid, within a time frame to be fixed by this Court. 5. Heard the learned counsel for the petitioner as well as the learned Government’s Counsel appearing for the respondents. Since no adverse orders are being passed against the respondents 5 to 11, notice to them is not necessary. 6.Considering the submissions made by both parties and in view of the limited prayer sought for in this writ petition, this Court without expressing any opinion on the merits of the case, directs the respondents 1 and 2 to consider the petitioner’s online application dated 19.01.2026 and conduct a survey and demarcate the subject properties, within a period of six (6) weeks from the date https://www.mhc.tn.gov.in/judis
WP No. 27103 of 2026 __________ Page5 of 7 of receipt of a copy of this order, after issuing prior notice and affording an opportunity of personal hearing to the petitioner and other parties concerned including the respondents 5 to 11. If any need arises for Police assistance, it is open to the respondents 1 to 3 to request for Police protection from the 4th respondent/jurisdictional Police. If any such request is made, the 4th respondent/jurisdictional Police is directed to provide an adequate Police protection for conducting the survey. 7.In the event of any dispute regarding possession, the respondents shall not adjudicate upon the question of title.
The petitioner and the concerned parties are at liberty to approach the competent Civil Court for recovery of possession and for appropriate reliefs in accordance with law. The official respondents shall not involve themselves in such proceedings or take any action affecting the rights of the parties unless specifically directed by the competent Civil Court. 8.With the above direction, this writ petition is disposed of.
