Taking into account that the petitioner has assailed the rejection of its technical bid, and in terms with the judgment of the Supreme Court in Afcons Infrastructure Ltd. Vs. Nagpur Metro Rail Corporation Ltd. & Another reported in (2016) 16 SCC 818, the Supreme Court had categorically observed that other technically competent bidders are required to be made parties, it is the opinion of this Court that the instant application is Page No.# 3/3 required to be allowed. 3. Accordingly, the present Interlocutory Application stands allowed, thereby impleading the opposite party Nos. 5 and 6 in the accompanying writ petition as respondent Nos. 5 and 6. 4. The learned counsel for the petitioner is directed to file a fresh Memo of Parties before the Registry of this Court within 7 (seven) days and the Registry shall on the basis of the said Memo of Parties and the present order make necessary corrections in the cause title and update the same in the CIS. 5.
