Kausik (Rejected) CRM (NDPS) 202 of 2026 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Goghat Police Station Case No. 295 of 2025 dated July 14, 2025 under Section 20(b)(ii)(C) of the NDPS Act, 1985. And In the matter of : Sk. Mantu ……Petitioner. Mr. Tapas Kr. Ghosh Mr. Tanmoy Chowdhury ……for the Petitioner. Mr. Bitasok Banerjee Mr. Bikram Mitra ……for the State. Learned advocate appearing for the petitioner submits that petitioner is in custody for 210 days. According to the learned advocate petitioner is a driver of the vehicle. On the other hand, learned advocate for the State opposes the prayer for bail and submits that there were recovery of 80.99 Kgs. of Ganja. Having considered the quantum of seizure which is of commercial quantity, I am of the view Section 37 of the NDPS Act is attracted. As such the prayer for bail of the petitioner is rejected at this stage. Thus, CRM (NDPS) 202 of 2026 is dismissed. 2 All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Tirthankar Ghosh, J.)
