Also heard Mr. Bankim Sarma, the learned Additional Public Prosecutor for the State of Assam. 2. This is an application under Section 483 of the BNSS, 2023, whereby the petitioner, namely, Jutika Kalita has prayed for releasing her on regular bail, after she was arrested in connection with Tezpur P.S. Case No.770/2025. 3. Mr. Sarma has submitted that the case diary was called for earlier but the same has not Page No.# 2/2 been received. 4. Mr. Yasin has submitted that the petitioner is in her 3rd trimester of her pregnancy and her medical condition is not good. According to Mr. Yasin, the medical condition of the petitioner should be considered at this stage. 5. There is no doubt that the petitioner is in her 3rd trimester of her pregnancy and only on this ground her application is allowed. 6. Accordingly, it is directed that the petitioner, namely, Jutika Kalita, who was arrested in connection with Tezpur P.S. Case No.770/2025, shall be released on bail of ₹25,000/- with a surety of like amount to the satisfaction of the learned Chief Judicial Magistrate, Sonitpur, Tezpur. 7. It is further directed that without any order from the learned Chief Judicial Magistrate, Sonitpur, Tezpur, the passport, which was earlier seized by the Investigating Officer, shall not be given back to the present petitioner.
