CRL OP No. 18908 of 2026 __________ Page2 of 4 ORDER The prayer in the criminal original petition is to quash the FIR in crime No.224 of 2026 dated 25.04.2026. 2.Upon considering the same, the gist of allegation made is that when the defacto complainant was at home, the accused came to his house and enquired for her husband. The de facto complainant wanted to know the reason, the accused replied that money matter. At the same time, her husband entered and there ensued a quarrel between both of them and in the end, the accused is said to have threatened the defacto complainant and her husband that they will eliminate them. 3.The learned counsel for the petitioner would submit that it is only the petitioner who suffered the injury and in respect of the same, a complaint has been registered in crime No.223 of 2026 and this is nothing but a frivolous counter blast to the genuine complaint. 4.When the two FIRs are registered with reference to case and counter relating to the same incident, then definitely the respondent police shall follow the dictum in T.Balaji Vs. State by Inspector of Police reported in 2024 (5) CTC 1 and decide as to who is the aggressor.
