Curiously, the Power Agent, expressing personal inconvenience to attend the proceedings before Family Court, Vellore, has come forward with the present request for transfer. 3. Admittedly, the respondent/wife has filed a petition in FCOP No.80 of 2026 before the Family Court, Vellore for dissolution of the marriage between the petitioner and the respondent. The petitioner is admittedly residing and employed abroad viz.,United Kingdom. Therefore, he has appointed his mother to be his power agent to represent him and conduct the proceedings on the file of Family Court, Vellore. 4. The present transfer request is at the behest of the Power Agent /Mother expressing inconvenience to attend the proceedings at Family Court, Vellore. 2/4 https://www.mhc.tn.gov.in/judis TR CMP No. 465 of 2026 5. Learned counsel appearing for the respondent vehemently opposes the request for transfer as not being maintainable since the convenience of the Power Agent cannot be a ground to entertain a request for transfer. 6. I have carefully considered the submissions of the learned counsel on either side. 7. I find force in the submission of the learned counsel for the respondent that the Power Agent’s convenience cannot be a sufficient ground for seeking transfer of the proceedings pending on the file of Family Court, Vellore. Further, in any event, the petitioner, who is party respondent before the Family Court, is not in a position to appear physically before the Family Court, Vellore. It is however, open to the petitioner to seek permission to appear through Video Conferencing and conduct the proceedings on his behalf in the event of the Power Agent, his mother, not being able to go over personally for all hearing dates. 8. It is made clear that the Family Court, Vellore shall not ordinarily insist on the physical presence of the petitioner or the Power Agent on all hearing dates. With the above observation, Tr.C.M.P.No.465 of 2026 is dismissed. No costs.
