The petitioner is accused No.8 in C.C.No.4529 of 2022. He is a director who resigned from the first accused Company much before the issuance of the cheque and the necessary materials have been placed on record by way of a memo. 4. This Court, by order dated 03.07.2023, quashed the pending criminal proceedings in respect of accused Nos.3 and 4 in the very same case, noting the fact that they were not in charge of the affairs of the first accused Company as on the date of commission of the offence. 5.
