The appellant has filed the present appeal impugning the order dated 02.06.2025, passed by the learned Single Judge in Writ Petition No.28218/2024 (GM-RES). 2. The learned counsel for the appellant submits that the learned Single Judge has directed the appellant (arrayed as respondent No.2 in Writ Petition No.28218/2024) to pay a sum of Rs.1,72,99,780/- together with interest at the rate of 6% per annum from 16.12.2023 till the date of payment, within a period of six weeks from the date of the said order. 3. The learned counsel for the appellant submits that the learned Single Judge has proceeded on the basis that the amount directed to be paid is an admitted debt owed - 4 - HC-KAR NC: 2026:KHC:24051-DB WA No. 551 of 2026 to the writ petitioner. He submits that no statement of objections was filed in the above writ petition. Thus, the appellant had not articulated its defence. 4. The impugned order indicates that learned counsel appearing for the appellant made a statement that the statement of objections filed in Writ Petition No.16979/2024 be treated as the statement of objection in the writ petition as well. In that matter, the amount of debt claimed was admittedly owed to the petitioner in that case. 5. We also notice that the present appeal has been filed after a delay of 219 days, for which, there is no credible explanation. 6. Considering that the present appeal is premised on the basis that an erroneous statement was recorded by the learned Single Judge, we dispose of the present appeal, granting liberty to the appellant to file a Review Petition. - 5 - HC-KAR NC: 2026:KHC:24051-DB WA No. 551 of 2026 7.
