Mr. M.K. Ray, learned counsel for the petitioners. 2. Mr. Suyash Pant, learned S.C. for the State. 3. Mr. S.S. Lingwal, learned counsel for respondent nos.2 and 3, through video conferencing. 4. Mr. Raunak Pant, learned counsel holding brief of Mr. Naresh Pant, learned counsel for respondent no.4. 5. By means of the present writ petition, the petitioners have challenged the notice dated 10.04.2026, annexure no.6 to the writ petition, whereby the petitioners were directed to remove the encroachment from the government land within a period of 15 days. 6. From perusal of the notice, annexure no.6 to the writ petition, it is reflected that the petitioners are directed to remove encroachment within a period of 15 days on their own or if they have any case against the notices they can appear before the respondent no.3-Estate Officer, Farm, G.B. Pant University of Agriculture and Technology, Pantnagar, Udham Singh Nagar upto 30.04.2026 between 11:00 A.M. to 12:00 noon to submit their assertion and evidence and relevant documents of their point of view and after the aforesaid assertion/evidence/documents submitted, after hearing, final decision would be taken. 7. Petitioners state that they had submitted their assertion, evidence and relevant documents to respondent no.3-Estate Officer, Farm, G.B. Pant University of Agriculture and Technology, Pantnagar, Udham Singh Nagar, on 13.04.2026, page no.132 to the writ petition. But the grievance of the petitioners is that the respondent no.3 has yet not taken any
2 decision on the reply of the petitioners given by them to respondent no.3-Estate Officer, Farm, G.B. Pant University of Agriculture and Technology, Pantnagar, Udham Singh Nagar. The respondents are pressing hard to remove the alleged encroachments. 8. In such view of the matter, the writ petition is disposed of finally with a direction to respondent no.3-Estate Officer, Farm, G.B. Pant University of Agriculture and Technology, Pantnagar, Udham Singh Nagar to consider the case of the petitioners as pointed out by them in their assertion/reply document and to decide their applications strictly, in accordance with law, after hearing the petitioners within a period of four weeks from today. 9. Till the reply of the petitioners is not considered, they shall not be removed from the land in-question. 10.
Let a certified copy of this order be supplied to the learned counsel for the parties, today itself, on payment of usual charges. (Pankaj Purohit, J.)
