For the State : A.C. to Sr. S.C.-I --- 02/10.04.2026 Heard Mr. Agnivesh, learned counsel for the petitioner and learned AC to Sr. S.C.-I. In this writ application, the petitioner has prayed for a direction upon the respondent no. 5 to pay compensation of Rs. 10,00,000/- to the petitioner on account of the fact that various parts of the Hywa Truck of the petitioner which was seized by the Police, has been stolen. The petitioner claims himself to be the registered owner of the Hywa Truck bearing Registration No. NL01AD4289. An FIR was instituted against the petitioner and other accused persons on the allegation that fiber chips were illegally loaded in the vehicle of the petitioner. The vehicle was seized and subsequently vide order dated 22.09.2025, the learned S.D.J.M., Sahibganj had directed the release of vehicle on certain conditions. Pursuant to the Release Order, the petitioner had taken charge of the vehicle and he had subsequently detected that various costly components of the vehicle has been missing and/or stolen. Consequent to the same, the petitioner had made a representation before the respondent no. 4 bringing to his notice the aforesaid fact and also claiming compensation for the loss which was sustained by the petitioner. It is the grievance of the petitioner that despite such Neutral Citation 2026:JHHC:10296 representation having been filed, the same has not been acted upon. Regard being had to the prayer made in this writ application, the same stands disposed of with a liberty to the petitioner to file a fresh representation before the respondent no. 4 within a period of 03 weeks from today and if such representation is preferred, the respondent no. 4 shall dispose of the same in accordance with law and after giving an opportunity of hearing to the petitioner within a period of 06 weeks from the date of receipt of the representation.
