Upon hearing the learned counsel on either side and the perusing the material records, it can be seen that petitioner along with other persons joined together and protested against the Citizenship Amendment Act (CAA) and the National Register of Citizens (NRC) Acts of the Central Government. It can be seen from the allegations that there was no criminal intention or the public order being affected or any violence in the said protest. Thus, the entire episode is nothing but an expression of democratic right to protest. 3. With reference to such cases, earlier GO.(MS).No. 368 dated 04.09.2021 is also issued by the Government whereunder, it was proposed to drop all the cases relating to CAA protest. In view thereof, this Criminal Original Petition stands allowed. The FIR in Crime No.82 of 2020 shall stand quashed in its entirety, against the other accused also.
