Petitioner has filed this writ petition, seeking following reliefs:- “1. Direct the respondents to transfer the petitioner to the Department of School Education, Government of Chhattisgarh; 2.Direct the respondents to grant service benefits to the petitioner in the department of School Education as per the seniority counted from the date of initial appointment in the department of Scheduled Tribe Development; 3. Pass any other order the Hon’ble Court may deem fit in the interest of justice.” 2. Learned counsel for the petitioner submits that petitioner was initially appointed as peon and posted at Middle School Samloor Gidam vide order dated 16.05.2011. Petitioner thereafter was attached to Pre Matric Boys Hostel Kasoli vide order dated 26.09.2012 issued by Block Educational Officer Gidam, South District Bastar, Dantewada. Subsequently, pursuant to the policy decision taken by State Government, all the schools have been absorbed in School Education Department. The employees working in schools of tribal department and others have been absorbed in the school department, however, petitioner though was appointed initially and working in school has not been absorbed. Petitioner thereafter, has submitted representation 3 / 3 before respondent no. 4 and 5, however, till date no decision has been taken. 3. Learned counsel for the State submits that in view of limited prayer made by learned counsel for petitioner, he is having no objection. 4. Considering the submission made by learned counsel for the respective parties and nature of grievance as raised by petitioner, I find it appropriate to dispose of this writ petition permitting petitioner to submit fresh comprehensive representation before respondent no. 4 and 5 raising all the grounds as raised in this writ petition and in the event petitioner submit such representation, it shall be considered and decided by respondent no. 4 and 5 in an objective manner, expeditiously, preferably within a further period of two months from the date of receipt of representation. 5.
