The petitioners are former office bearers and Directors of the 3rd respondent Society and during their service, the 2nd respondent ordered enquiry under Section 81 of the Tamil Nadu Co-operative Societies Act in respect of the alleged non-recovery of certain loans advanced by the 3rd respondent society. Pursuant thereto, enquriy was conducted and report was submitted, stating that the Society had suffered loss due to non-recovery of 115 loans that had become time barred. The grievance of the petitioners is that though majority of the loans were disbursed right from the year 1999 to 2023 while the petitioners served only between 2013 to 2023, for the non recovery of the said loans, the petitioners were made responsible. 3. The learned counsel for the petitioner would submit that though the surcharge proceedings were concluded in the year 2025, the same was sent with 2/4 https://www.mhc.tn.gov.in/judis WP No. 27085 of 2026 a delay of one year which is evident from the printouts regarding the service of the surcharge order. Further the learned counsel submitted that the loans were lapsed for a period of seven years, and that the same cannot be recovered from these petitioners / office bearers. 4. All these grounds can be raised only before the District Court / Tribunal where statutory appeal lies against the surcharge order. Hence, the writ petition is not maintainable. However, limitation period for filing an appeal by the petitioners, if any, shall be adjudicated by the Tribunal and entertain the appeal, in accordance with law. 5. With the above observations, this writ petition stands disposed of. No costs. Consequently, connected miscellaneous petitions are closed.
