The petitioners are apprehending their arrest in connection with Sahibganj (M) P.S. Case No.12/2019, for the offences registered u/s. 175, 379 and 414 Indian Penal Code and section 21 (A), 21(6)/22/04/54 of JH.M.M. Act. 3. Learned Counsel appearing for the petitioners submits that the petitioners happened to be the owners of different trucks and the allegations are made of unloading stone chips on the Steamer. He also submits that the petitioners have got no criminal antecedents as disclosed in para 9 of the petition. He then submits that in the seizure list, only the vehicles are seized and there is no seizure of mineral. 4. Learned Counsel appearing for the State opposed the prayer and submits that on the steamer, from the vehicle, stone chips were being unloaded. 5. Considering that the petitioners are said to be the owner of different trucks, they are having no criminal antecedents as disclosed 2026:JHHC:4999 2 in para 9 of the petition, in the seizure list, only the trucks are seized, minerals are not seized, in that view of the matter, the petitioners above named are directed to surrender before the learned Court within two weeks and the learned Court shall release the petitioners on such terms and condition and sureties, the learned Court may deem fit and proper.
