1. The present Petition, under Section 11(6) of the Arbitration and Conciliation Act, 1996 [“Act”], has been filed seeking the appointment of a Sole Arbitrator.
2. After addressing some arguments and upon the Court querying the learned counsel on how he could invoke the Arbitration clause as he does not appear to qualify as a “member”, learned counsel for the Petitioner sought leave of the Court to withdraw the present Petition, with liberty to take appropriate steps as are available under law.
3. Considering that the Petitioner had no locus to file the present Petition and expended precious judicial time and resources, leave and liberty, as sought for, are granted, subject to the Petitioner depositing a sum of Rs. 25,000/- in favour of the Delhi High Court Bar This is a digitally signed order.
