This petition is taken out by the injured claimant seeking permission of this Court to withdraw the amount of Rs.3,50,000/- deposited by the respondent/appellant before the trial Court to the credit of O.S.No.287 of 2019 pending disposal of the appeal. 3. It appears that the said sum was deposited in to the trial Court to the credit of O.S.No.287 of 2019 on 06.01.2026. 4. The learned counsel for the respondent/appellant/defendant has got serious objections in allowing this petition. 5. Originally suit was laid by the respondent / petitioner Sakkarai @ Sakkaravarthy seeking a direction against the defendant to pay a sum of Rs.20,00,000/- with interest at 9% p.a., from the date of accident till date of realisation. 2/4 https://www.mhc.tn.gov.in/judis C.M.P.No.16654 of 2026 in A.S.No.1040 of 2025 6. Petitioner/plaintiff contended that due to electric accident on 11.10.2018 at 7.30 p.m., at Paithambadi Sathiram Village, Cuddalore, when he was going to his lands, he came into contact with a snapped live High Tension Wire and sustained second degree burn injuries over his left forearm, left shoulder, chest both legs and thigh on account of electrocusion. Ex.A6 discharge summary has been issued by Sri Ramachandra Hospital, Chennai, wherein he was admitted on the date of accident and discharged on 29.11.2018. 7. At the time of admission, this Court ordered the appellant to deposit a sum of Rs.3,50,000/- and the same has been deposited by the appellant/defendant on 06.01.2026. 8.
