The allegation against the petitioner is that he, along with three other persons, committed theft of three goats with the help of a gun, and upon being questioned by the de facto complainant, the accused dropped the firearm and fled from the spot, leading to the registration of the present case 3. The learned counsel for the petitioner submitted that the petitioner is an innocent and he has been falsely implicated in this case and he has not committed any offence as alleged by the prosecution. He further submitted that the petitioner is ready to abide by any conditions that may be imposed by this Court. Hence, he prayed to grant anticipatory bail to the petitioner. 4. Per contra, the learned Government Advocate (Crl. Side) appearing for the respondent police reiterated the prosecution's case and, upon instructions, submitted that the occurrence took place on 24.06.2025. She stated that the allegation against the petitioner is that he committed theft of three goats, out of which one goat was subsequently recovered, and that the petitioner was also found in possession of a country-made gun. She further submitted that the petitioner has no previous cases pending against him. Hence, she opposed the grant of anticipatory bail to the petitioner. 5. I have given my anxious consideration to either side submissions. 6. From the submissions made by the learned counsel for the petitioner, it is seen that the occurrence took place in the year 2025 and that the petitioner has no adverse antecedents. In view of these circumstances, this Court is of the firm view that custodial interrogation of the petitioner is not required.
