1. The present bail application has been filed under Section 482 BNSS in connection with FIR No. 87/2023 registered at Police Station Babai District Neem Ka Thana for the offence(s) under Sections 8, 21, 22 of Narcotic Drugs and Psychotropic Substances Act, 1985.

Learned counsel for the accused-applicant submits that the applicant is the sole bread earner of his family, aged about 51 years. It is submitted that there are no criminal antecedents registered against the applicant. It is further submitted that prime accused in the alleged offences has already been granted the concession of bail by the Coordinate Bench of this Court. It is also submitted that the applicant has falsely been implicated in the present matter as an abettor merely on the basis that one of his employee was found to be involved in a financial transaction
[2026:RJ-JP:12863] (2 of 3) [CRLMB-2498/2026] through the ‘PhonePe’ application. Furthermore, it is submitted that application is the bona fide owner of the medical shop.
Learned counsel also submits that the applicant is ready to abide by the conditions, if any, imposed by this Court while enlarging the applicant on bail.
3. Per contra, learned Public Prosecutor has vehemently opposed the instant bail application.

Having heard the arguments advanced by the learned counsel for the parties and considering the fact that accused- applicant is the sole bread earner of his family, aged about 51 years; that there are no criminal antecedents registered against the applicant; that the co-accused has already enlarged on bail by the Co-ordinate Bench of this Court under the similar facts and circumstances and looking to the overall facts and circumstances of the case and material on record but without commenting on merits/demerits of the case, this court is inclined to allow the bail application of the accused-applicant.
5. Accordingly, the anticipatory bail application is allowed. The S.H.O/I.O/Arresting Officer, Police Station Babai District Neem Ka Thana in F.I.R. No. 87/2023 is directed that in the event of arrest of the accused-applicant Bhoop Singh S/o Bhikharam, he shall be released on bail, provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties in the sum of Rs.25,000/- each to the satisfaction of the S.H.O/I.O/Arresting Officer of the concerned Police Station on the following conditions:- (i) that the applicant shall make himself available for interrogation by a police officer as and when required;
[2026:RJ-JP:12863] (3 of 3) [CRLMB-2498/2026] (ii) that the applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the court or any police officer, and (iii) that the applicant shall not leave India without previous permission of the court.
