The case of the prosecution is that the petitioner was found to be in possession of 215.14 kg of tobacco products kept in the vehicle (1) 94.5 kg of Hans kept in 313 pouches, (each weighed 300 grams), 2) 27.34 kg of cool lip kept in 163 pouches, (each 86 grams), 3) 18.1k.g of VI tobacco kept in 905 pouches (each 20 grams), 4) 75.2 kg of vimal pan masala kept in 881 pouches (each 57 grams). Hence, the case. 3. The learned counsel appearing for the petitioner submitted that the petitioner has been falsely implicated in the present case and that she has not committed any offence as alleged by the prosecution. He further submitted that the petitioner is ready to abide by any stringent conditions that may be imposed by this Court. Hence, he prays for grant of bail to the Petitioner. 4. Per contra, the learned Government Advocate (Criminal Side) appearing for the Respondent Police reiterated the prosecution case and submitted that the petitioner has been incarcerated since 20.06.2026 and further submitted that the petitioner has got one previous case similar in nature. I have given my anxious consideration to either side submissions and perused the materials available on record. 6. At this juncture, the learned counsel for the petitioner volunteered himself to deposit a sum of Rs.50,000/-. 7. Considering the facts and circumstances of the case; taking note of the submission made by the learned Government Advocate (Crl.Side); though the petitioner has got one previous case similar in nature, considering the period of incarceration of the petitioner, this Court is of the view that further custody for the purpose of investigation is not required. Hence, this Court is inclined to enlarge the petitioner on bail subject to certain conditions. 8. Accordingly, the petitioner is ordered to be released on bail on his executing a bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties each (among two sureties, one should be a blood surety and one should be a local surety), for a like sum to the satisfaction of the learned Judicial Magistrate No.2, Salem, and on further conditions that: [a] the sureties shall affix their photographs and Left Thumb Impression in the Application for Surety ship [Judicial Form No.46 annexed to 'The Criminal Rules of Practice, 2019']. CRL OP No. 19503 of 2026 __________ Page4 of 6 b] The petitioner is directed to make a non-refundable deposit of Rs.50,000/- [Rupees Fifty Thousand Only] in favour of the Dean, Government Mohan Kumaramangalam Medical College and Hospital, Salem within a period of four weeks from the date of receipt of a copy of this order.
[c] the petitioner shall report before the respondent police daily at 10.30 a.m., for the period of two weeks and thereafter, as and when required for interrogation; [d] the petitioner shall not abscond either during investigation or trial; [e] the petitioner shall not tamper with the evidence or witness either during investigation or trial; [f] On breach of any of the aforementioned conditions, the learned Magistrate/Trial Court is entitled to pass appropriate orders against the petitioner in accordance with law as if the aforementioned conditions have been imposed and the petitioner released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)13 SCC 283]; [g] If the accused thereafter absconds, a fresh FIR can be registered under Section 269 of B.N.S. 22-07-2026 SHL https://www.mhc.tn.gov.in/judis
