M/S GANESH JEWELLERS Versus M/S SHIVAM JEWELLERS CRMPM-424 of 2026 23.03.2026 Present: Mr. Servedaman Rathore, Advocate, for the applicant/petitioner. CRMPM-424 of 2026 By way of instant application filed under Section 5 of Limitation Act, prayer has been made on behalf of the applicant/petitioner for condonation of delay in maintaining the accompanying criminal revision petition, which is barred by limitation. Though having carefully perused the averments contained in the application, this Court is not convinced with the explaination rendered on record qua delay in maintaining accompanying criminal revision, however, having taken note of the fact that petitioner is ready and willing to pay the entire amount of compensation awarded by learned Court below as is evident from the demand draft drawn in the name of Registrar, HP High Court, Shimla, amounting to Rs.1,75,000/-, coupled with the fact that petitioner is ready and willing to pay the entire amount of compensation in terms of judgment of conviction and order of sentence dated 13.03.2023 recorded by the learned Court below, this Court finds no impediment in condoning the delay, as such, the same deserves to be condoned. In view of above, delay of 24 days is condoned. The application is disposed of. Cr. Revision No. _______ of 2026 (CR.RST- 1687 of 2026) & CrMPST-1689/2026 Be registered. Notice to respondent be issued, returnable for 28.05.2026, on taking steps within two days. While issuing notice in aforesaid terms, Registry of this court may also send copy of instant order so that factum with regard to deposit of money by way of demand draft with the Registry of this court comes to the knowledge of the respondent. Demand draft, as detailed hereinabove, shall be deposited with the Registry of this court during the course of the day, which shall be invested in FDR till further orders. Since petitioner is ready and willing to pay the entire amount of compensation, judgment of conviction and order of sentence dtaed 13.09.2023 shall remain suspended till the next date of hearing.
