Mr. Tajhar Qayyum, learned counsel for the Applicant. 2. Mr. Pradeep Lohani, learned AGA, for the State of Uttarakhand. 3. The present Bail Application has been filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, seeking regular bail in connection with FIR No. 0029 of 2026, registered under Sections 336(3), 338 and 339 of the B.N.S., 2023 at Police Station Kaliyar Sharif, District Haridwar. 4. Heard learned counsel for the Applicant and learned A.G.A. for the State. Perused the record. 5. Learned counsel for the Applicant submits that the Applicant is innocent and has been falsely implicated in the present case and that the alleged recovery is false and fabricated. It is further submitted that the Applicant is languishing in jail since 20.02.2026 and has no previous criminal history to his credit. Learned counsel further submits that the Applicant is ready to cooperate with the trial proceedings and there is no likelihood of misuse of liberty, if enlarged on bail. 6. Per contra, learned State Counsel has vehemently opposed the Bail Application on the ground that the Applicant has previous criminal history. 7. Considering the overall facts and circumstances of the case, the nature of allegations levelled against the Applicant,
the period of incarceration already undergone, and without expressing any opinion on the merits of the matter, this Court is of the view that the Applicant has made out a fit case for grant of bail. 8. Accordingly, the Bail Application is allowed. 9. Let the Applicant be released on bail in connection with FIR No. 0029 of 2026, under Sections 336(3), 338 and 339 of the B.N.S., 2023, registered at Police Station Kaliyar Sharif, District Haridwar, upon furnishing a personal bond and two reliable sureties, each in the like amount, to the satisfaction of the court concerned. 10. It is made clear that the Applicant shall cooperate with the trial proceedings and shall not misuse the liberty granted to him.
It is also made clear that any observation made hereinabove is only for the purpose of adjudication of the present Bail Application and shall not be construed as an expression on the merits of the case. 11. All pending applications, if any, shall stand disposed of. ( Ash ish Nait h an i, J.)
