Jaiswal, Advocate ------ Order No.02 / Dated : 20.01.2026. Heard both the sides. The petitioner- abovenamed who is in custody since 12.11.2025 in connection with Bokaro Thermal P.S. Case No.71 of 2025 for the offence registered under Sections 127(2), 352, 351(3) of B.N.S., 2023 and Sections 8, 12 of the POCSO Act has prayed for regular bail. As per the prosecution case, the petitioner committed sexual assault on the informant/ boy aged about 16 years in attempt to commit unnatural sex by asking him to remove his clothes. It is submitted by the learned counsel on behalf of petitioner that petitioner is about 69 years old and there is delay of 15 days in lodging the FIR. Further, charge has also been framed. Learned A.P.P. for the State assisted by learned counsel for the informant has opposed the prayer for bail. It is submitted that the petitioner was earlier convicted for the offence of similar nature by the Trial Court. However, he was acquitted by this Court in Crl. Revision No.462 of 2015. It is also submitted that he is also an accused in case of murder of his son. However, no details regarding the same has been furnished. Considering the nature of allegation and past criminal antecedent, the prayer for bail of the petitioner, is hereby, rejected. However, learned Trial Court is directed to expedite the trial.
