GP FOR ENDOWMENTS The Court made the following: 3 THE HONOURABLE SRI JUSTICE TARLADA RAJASEKHAR RAO WRIT PETITION No.18907 OF 2026 ORDER: The present Writ Petition is filed under Article 226 of the Constitution of India seeking the following relief: “…to issue an appropriate writ, order or direction, more particularly one in the nature of Writ of Mandamus declaring the action of the respondents no.2 to 4 in not upgrading the Section 43(10) Register of Andhra Pradesh Charitable and Hindu Religious Institutions and Endowments Act, 1987 of Sri Bala Tripura Sundari Sametha Sri Umamaheswara Swamy Temple (Kothapet Sivalayam), Guntur, Guntur District, as per the proceedings issued by the 2nd respondent vide N.Dis.No.D2/14021(51)/45/2026 dated 12.06.2026 by considering petitioner representation dated 12.06.2026 and 03.07.2026 as bad, illegal, arbitrary and violative of Articles 14, 1, 25 and 26 of Constitution of India and violative of principles of natural justice and consequently direct the respondents no.2 to 4 to upgrade the Section 43 (10) of Act 30/87 Register of the 5th respondent institution from time to time and pass such other order or orders.…” 2. The petitioner submitted representations dated 12.06.2026 and 03.07.2026 to respondent Nos.3 and 4 stating that Sri Bala Tripura Sundari Sametha Sri Uma Maheswara Swamy Temple (Kothapet Sivalayam), Guntur, has been published under Section 6(b)(ii) of the Andhra Pradesh Charitable and Hindu Religious Institutions and Endowments Act, 1987 (hereinafter for short the ‘Act’), which is under administrative control of the Deputy Commissioner, Endowments Department, Guntur, Guntur District. 3. The said temple was established by great grandfather of the petitioner Sri Nadimpalli Ramayya Pantulu in the year 1896. After his death, his son Sri Nadimpalli Venkata Lakshmi Narasimha Rao, came into management of the said temple. After his death on 16.01.1978, his son and petitioner’s father Sri 4 Nadimpalli Satya Ramayya Pantulu came into management of the said temple. Thereafter, the petitioner is managing the affairs of the temple. The said facts were incarnated on the Dhwaja Stambham in the temple clearly mentioning about the details of establishment of Dhwaja Stambham. 4. In addition to that some more facts were stated in the representation. Inspite of all the above aspects, the Executive Officers of the temple failed to mention the said aspects in the Property Register of the Temple under Section 43 of the Act, even though there is a duty cast upon them under Section 43(10) of the Act for making entries by updation of the Property Register while entering the omissions or additions regarding the said particulars. Hence, the present writ petition came to be filed to direct the respondents to make an enquiry and pass appropriate orders in accordance with law. 5. Heard learned counsel for the petitioner and learned counsel appearing on behalf of respondents. 6. Learned counsel for the petitioner would submit that it would suffice to direct the respondent No.3 to dispose of the petitioner’s representation dated 12.06.2026 and 03.07.2026 in accordance with law. 7. Learned counsel for the respondents have not opposed the said request either specifically or significantly. 8. Hence, the present Writ Petition is disposed of, at the admission stage, directing respondent No.3 to examine the petitioner’s representations dated 12.06.2026 and 03.07.2026, and pass appropriate orders in accordance with law, and communicate the decision to the petitioner within a period of four (04) 5 weeks from the date of receipt of a copy of this order. There shall be no order as to costs.
