In this application petitioner has prayed for a direction upon the court below for expeditious disposal of the proceeding being Complaint Case No. CS/53706/18 presently pending before learned Judicial Magistrate, 14th Court Calcutta. Petitioner submits that he filed a complaint under section 138 of the N.I. Act, before the court below on 07.06.2018 and till date evidence of PW1 has not yet been completed and due to such inordinate delay caused in disposal of the case, the petitioner is suffering a lot. Having heard learned counsel for the petitioner, and that the prayer made by the petitioner is innocuous and, if it is allowed in terms of the prayer made in the petition, the opposite party will have no cause to prejudice, service of copy of application upon the opposite party is dispensed with. Having heard learned counsel for the petitioner and that the prayer made on behalf of the petitioner is justified in terms of long pendency of the proceeding, the instant application being CRR 151 of 2026 is hereby disposed of with a direction upon the Court below to make every endeavour for expeditious disposal of the Complaint case no. CS/53706/18 and to make his best effort to conclude the entire proceeding preferably within a period of six
2 months from the next date of hearing without granting any unnecessary adjournment to either of the parties. Urgent Photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
