The Criminal Petition has been filed under Section 439(1)(b) of the Code of Criminal Procedure, 1973 (for brevity ‘the Cr.P.C.,’)/Section 483(1)(b) of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity ‘the BNSS’), seeking to modify the condition imposed on the petitioner/Accused No.4 vide order dated 24.02.2026 in Crl.M.P.No.1094 of 2025 in Crime No.26 of 2020, passed by the leaned IX Additional District and Sessions Judge, Chittoor.
2. The learned counsel for the petitioner submits that the financial condition of the petitioner is deplorable and he is unable to comply with the conditions imposed by the learned Trial Court.
3. Heard learned counsel for the petitioner and the learned Assistant Public Prosecutor. Perused the record.
4. Considering the above facts and circumstances of the case, the order dated 24.02.2026 in Crl.M.P.No.1094 of 2025 in Crime No.26 of 2020, passed by the leaned IX Additional District and Sessions Judge, Chittoor, against the petitioner/Accused No.4 is hereby modified as under: i. The petitioner/Accused No.4 shall report before the Station House Officer, Kuppam Urban Police Station, on the first Monday of every month between 10:00 a.m. and 5:00 p.m until the filing of the charge sheet.
5. The residual conditions imposed by the learned Trial Court, in the original order shall remain in force and shall be duly complied with by the Petitioner/Accused No.4.
6. Accordingly, the Criminal Petition is disposed of.
