The petitioners are apprehending their arrest in connection with Bharno PS Case No.76 of 2025, for offence registered under section 303(2), 317(5), 3(5) of BNS, 2023, Sectio 21 of Mines and Minerals (Development and Regulaton) Act, 1957, Rule 54 of Jharkhand Minor Mineral Concession Rules, 2004 and Rule 13 of Jharkhand Minerals (Prevention of Illegal Mining, Transportation and Storage) Rules, 2017, pending in court of learned Additional Chief Judicial Magistrate, Gumla. 3. Learned counsel for the petitioners submits that the petitioners are the owner of two different Hywa trucks and the allegations are made of loading 960 cft sand on each of the vehicle. 2026:JHHC:2810 2 He next submits that the petitioners are having no criminal antecedent as disclosed in paragraph no.11 of the petition. 4. Learned State counsel opposes prayer and submits that the allegations are there of illegally transporting 960 cft sand. 5. Considering that petitioners are the owner of two different Hywa trucks and the petitioners are having no criminal antecedent as disclosed in paragraph no.11 of the petition, and in that view of the matter, both the petitioners, above named, are directed to surrender before learned court within two weeks from today and learned court shall release petitioners, above named, on such terms and conditions as well as sureties as learned court may deem fit and proper. 6.
