W.P.No.28155 of 2026 Page Nos.2/5 Writ Petition filed under Article 226 of the Constitution of India seeking a Writ of Certiorari, to call for the records of 1st respondent made in G.O.Ms.No.441, Home (Transport-VII) Department dated 28.08.2025 and quash the same. For Petitioner : Mr.M.Palani For Respondents : Mr.P.Siddarth Government Counsel, for R1 & R2 Mr.J.Vasu, Senior Panel Counsel, for R3 ***** O R D E R The petitioner, Tamil Nadu Driving Schools Owners Federation, a registered association, challenges G.O.Ms.No.441, Home (Transport-VII) Department, dated 28.08.2025, whereby the Government sanctioned a sum of Rs.1,27,34,000/- for execution of civil works, through the Rural Development Department, for establishing Automated Driving Test Tracks in ten Regional Transport Offices. 2. The petitioner contends that the impugned Government Order is contrary to Rule 15 of the Central Motor Vehicles Rules, 1989, on the ground that it authorises the Regional Transport Officers to conduct driving tests in a manner inconsistent with the said Rule. https://www.mhc.tn.gov.in/judis

3. Heard the learned counsel appearing on either side and perused the materials on record. 4. A plain reading of the impugned Government Order shows that it merely sanctions funds for execution of civil works required for establishing Automated Driving Test Tracks. The Government Order does not prescribe the mode, manner or procedure for conducting driving tests, nor does it authorise the Regional Transport Officers to deviate from the procedure prescribed under Rule 15 of the Central Motor Vehicles Rules, 1989. Therefore, the apprehension of the petitioner that the impugned Government Order directs the Regional Transport Officers to conduct driving tests contrary to Rule 15 is wholly misconceived and without any basis. 5. Accordingly, the writ petition is dismissed. Consequently, the connected miscellaneous petitions are closed.
