SODUM ANVESHA Counsel for the Respondent(S): 1. GP FOR SERVICES I The Court made the following: 3 THE HONOURABLE SRI JUSTICE NYAPATHY VIJAY WRIT PETITION No.18001 of 2026 ORDER: 1. The present Writ Petition is filed questioning the G.O.Rt.No.351, MA & UD (Vig.III) Department, dated 23.03.2026 passed by Respondent No.1 and imposing punishment of censure, as illegal and arbitrary. 2. The Petitioner was initially appointed as a Tracer on 12.09.1984 and was subsequently promoted to the post of Executive Engineer on 03.04.2017. He is presently serving as an Executive Engineer in the Nellore Municipal Corporation. While so, the Respondent No.1 initiated disciplinary enquiry against the Petitioner under Rule No.20 of Andhra Pradesh Civil Services (Classification, Control and Appeal) Rules, 1991 and issued a charge memorandum vide G.O.Ms.No.406& 410, Municipal Administration & Urban Development (Vig.III.1) Department, dated 08.06.2017 with regard to certain irregularities in discharge of his duties as Deputy Executive Engineer, Ongole Municipal Corporation. 3. Pursuant thereto, an enquiry was conducted and upon conclusion of enquiry, the disciplinary authority imposed a penalty of “Censure” vide 4 G.O.Rt.No.351, MA & UD (Vig.III) Department, dated 23.03.2026. Questioning the same, the Writ Petition is filed. 4. Learned counsel for the Petitioner submitted that the Petitioner had filed an application seeking for review of the impugned order before the State Government as provided under Rule No.38 of Andhra Pradesh Civil Services (Classification, Control and Appeal) Rules, 1991 and it would suffice, if the State Government is directed to examine the review application filed by the Petitioner and to pass appropriate orders. 5. Learned Assistant Government Pleader submitted that the review application filed by the Petitioner would be examined and appropriate orders will be communicated to the Petitioner. 6. Heard the counsels. 7. Considering the submissions, the Writ Petition is disposed of, with the following directions:- (i) The Respondent-Authorities are directed to examine the review application, dated 01.06.2026 and 24.03.2026 filed by the Petitioner, as expeditiously as possible, 5 preferably within a period of two months from the date of receipt of a copy of this order. (ii). No order as to costs. 8.
