THIS PETITION, COMING ON FOR PRELIMINARY HEARING, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MR. JUSTICE S.R.KRISHNA KUMAR ORAL ORDER In this petition, petitioner seeks the following reliefs: (i) Call for records which is ultimately resulted in passing the alleged impugned order dated 16.04.2025 passed by - 3 - HC-KAR NC: 2026:KHC:24042 WP No. 13574 of 2026 Disciplinary Authority (Respondent No 4) vide his Memo Estt/SSFC/Ct GN Math/88/2025/7435-53 dated 16.04.2025 (Annexure-D). (ii) Issue a Writ or order by way of certiorari quashing the impugned order GN bearing No Estt/SSFC/Ct Math/88/2025/7435-53 dated 16.04.2025( Vide Annexure-D) passed by Respondent No 4 and declare the same to be illegal, one sided, unfounded and arbitrary simultaneously setting aside penalty orders of Disciplinary Authority (Respondent No 4) at Annexure-D. (iii) Thereafter issue the directions to the Respondents to discharge the Petitioner on voluntary retirement immediately which was already approved on 4.11.2024 (vide Annexure- B) with effect from 31.01.2025 with all consequential benefits. iv) Issue a consequent direction to the Respondents to extend all the consequential benefits like continuity of service, back wages and other benefits. (iv) Pass any such order(s), Writ, directions as this Hon'ble Court deems fit in the facts and circumstances of the case in the interest of justice and equity. 2. After arguing the matter for sometime, learned counsel for the petitioner submits that the petitioner has filed an appeal before the respondent No.3, which has not been disposed of even till today and the present petition may be disposed of directing the respondent No.3 to dispose of the appeal filed by the petitioner within a stipulated time frame. 3. Petition stands disposed of directing the respondent No.3 appellate authority to dispose of the appeal at Annexure E dated 11.07.2025 submitted by the petition within a period of three months from the date of receipt of a copy of this order.
