THIS WRIT PETITION, COMING ON FOR ORDERS, THIS DAY, ORDER WAS MADE THEREIN AS UNDER:
CORAM: THE HON'BLE SMT. JUSTICE LALITHA KANNEGANTI
ORAL ORDER
The writ petition is filed questioning the order dated 29.03.2019 passed on IA No.8 in MVC No.938/2015 on the file of MACT, Ballari.
2. On 29.08.2019, a co-ordinate Bench of this Court had granted stay of all further proceedings in MVC No.938/2015 and it came to be extended from time to time. In fact, there was an order directing the petitioner to appear before the Medical Board.
3. A letter is addressed by the learned I Addl. District and Sessions Judge, Ballari, dated 23.12.2025 stating that the matter is stayed from 2019 and the petitioner inspite of order passed by this Court, has not appeared before the Medical Board. Hence, as it is an old matter, request is made for early disposal of the writ petition.
4. Today, when the matter came up, memo is filed by the learned counsel for the petitioner that he wants to withdraw the writ petition. It is so unfortunate that right from 2019, the

proceedings are being stayed and the petitioner has not even chosen to appear before the Medical Board.
5. The memo is taken on record. The petitioner is permitted to withdraw the writ petition. Hence, this Court is passing the following:
ORDER i) The Tribunal shall dispose of the matter as expeditiously as possible, but not later than three months. ii) If the petitioner fails to appear before the Medical Board, the Tribunal is at liberty to proceed with the matter and pass appropriate orders. iii) Accordingly, the writ petition stands dismissed as withdrawn. iv) All I.A.s in this writ petition shall stand closed.
