Affidavit of service filed in Court today is taken on record. The petitioners claim to be the recorded owner of L.R. Plot No.495 under Khatian No.144/1 and 1650 within Mouza-Kamarbar under Police Station-Tamluk in the District of Purba Medinipur. The petitioners allege that the respondent/Hindustan Petroleum Corporation Ltd. is taking steps to install the pipe line through the property of the petitioners in spite of an objection being raised by the petitioners by a letter dated July 13, 2023. Mr. Banerjee, learned advocate appearing for the petitioners submits that pursuant the objection raised by the petitioners vide letter dated July 13, 2023, the petitioners were called for a hearing. He submits that the petitioners duly attended the said hearing but till date the

decision of such hearing has not been communicated to the petitioners. The learned advocate appearing for the respondent/Hindustan Petroleum Corporation Ltd. submits that the petitioners duly attended the hearing before the authorities and on October 4, 2023 an order was passed rejecting the objection filed by the petitioners. After going through the order dated October 4, 2023, this Court finds that the authority has observed that the diversion as prayed for by the petitioners is not at all feasible. However, compensation as per the Petroleum and Minerals Pipelines (Acquisition of right of user in Land) Act, 1962 shall be paid. Mr. Banerjee, learned advocate appearing for the petitioners submits that the said decision has not yet been communicated to the petitioners. A copy of the order has been handed over to Mr. Banerjee, learned advocate for the petitioners, in course of hearing of this writ petition. WPA 1590 of 2026 stands disposed of leaving the petitioners free to take appropriate steps in accordance with law, if so advised. Since no affidavits have been called for, the allegations contained in the writ petition shall not be deemed to have been admitted. There will be no order as to costs. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
