Hon'ble Shri Justice Parth Prateem Sahu Order On Board 13/02/2026 1. Petitioner has filled this petition seeking the following reliefs:- “10.1 That, this Hon'ble Court may kindly be pleased to issue a writ of mandamus directing respondents to declare petitioners as temporary members of the Work- Charged/Contingency establishment effective from the day following completion of 3 years of service and declare them permanent members upon completion of 10 years. 10.2 That, this Hon'ble Court may kindly be pleased to issue a writ of mandamus directing respondents to grant the same benefit to the petitioner as it was granted to 108 peons vide order dated 19.01.2022 (Annexure P-3). 10.3 That, this Hon'ble Court may kindly be pleased to issue a writ of mandamus directing respondents to appoint the petitioners as Work-Charged/Contingency establishment and fix and grant pay scale of Rs.4750- 7440 + GP Rs.1300 (or equivalent revised Pay Band Level-01: Rs.15600-49400) per CG Work-Charged & Contingency Employee Pay Revision Rules, 2017, with all allowances, from the due dates. 6 10.4 That, this Hon'ble Court may kindly be pleased to issue a writ of mandamus directing respondents to pay arrears of salary difference with interest e.g. 9% p.a. from respective eligibility dates till payment. 10.5 That, this Hon'ble Court may kindly be pleased to issue a writ of mandamus directing respondents to consider the representation dated 01.04.2024 (Annexure P-4) within a time-bound period. 10.6 That, this Hon'ble Court may kindly be pleased to grant any other relief/relief's in favour of the petitioner, which the Hon'ble Court deemed fit & just in the facts and circumstances.” 2. Learned counsel for petitioners would submit that petitioners were initially employed as daily wage employee and pursuant to the notification issued by the erstwhile State of Madhya Pradesh and State of Chhattisgarh, petitioners have submitted representation on 01.04.2024 (Annexure P-4) before respondent No.1 for fixation of regular pay, which till date is pending consideration, therefore, direction be issued to respondent No.1 to take decision on the representation submitted by petitioners at the earliest within specified time frame. 3. Learned State counsel submits that in view of the limited prayer made by leaned counsel for petitioners, he is having no objection. 4. On due consideration of the submission of learned counsel for parties and looking to the nature of grievance raised, this writ petition at this stage is disposed of directing respondent No.1 to take decision on the pending representation (Annexure P-4) submitted by petitioners, in accordance with law, expeditiously preferably within further period of six months from the date of receipt of this order. 7 5.
