Crl.O.P.No.18997 of 2026 IN THE HIGH COURT OF JUDICATURE AT MADRAS DATED : 17.07.2026 CORAM THE HONOURABLE Mr. JUSTICE G.K. ILANTHIRAIYAN Crl.O.P.No.18997 of 2026 Balamurugan ... Petitioner(s) Vs. The State rep. by The Inspector of Police, Acharapakkam Police Station. ... Respondent(s) Crime No.308 of 2022 PRAYER : Criminal Original Petition filed under Section 483 of BNSS, 2023, to enlarge the petitioner on bail in P.R.C.No.22 of 2023 on the file of the respondent police. For Petitioner(s) : Mr.V.ManimaraU+006e For Respondent(s) : Mr.S.Yogaraj Sekar, Government Advocate (Crl.Side) ORDER The petitioner, who had earlier jumped bail, was issued a non-bailable warrant on 26.07.2023, pursuant to which he was arrested and remanded to judicial custody on 05.02.2026. 1/4 https://www.mhc.tn.gov.in/judis Crl.O.P.No.18997 of 2026 2. The learned counsel appearing for the petitioner would submit that a non-bailable warrant had been issued against the petitioner on 26.07.2023 and that he was subsequently secured and remanded to judicial custody on 05.02.2026. He would further submit that the petitioner is ready to abide by any stringent conditions that may be imposed by this Court. Hence, he prayed for grant of bail. 3. The learned Government Advocate (Crl. Side) appearing for the respondent, while opposing the grant of bail, reiterated the prosecution case and, on instructions, submitted that the petitioner had been absconding for nearly 2½ years and was secured only on 05.02.2026. He further submitted that the petitioner has 46 previous cases. He would contend that, if the petitioner is enlarged on bail, there is every likelihood of his absconding again and thereby delaying the trial. 4. Considering the above facts and circumstances, the past conduct of the petitioner, the fact that he had absconded for a period of nearly 2½ years, and upon the submissions made by the learned Government Advocate (Crl. Side), this Court is of the view that there is every likelihood of the petitioner absconding again if he is enlarged on bail. Therefore, in order to secure his presence during trial, this Court is not inclined to grant bail to the petitioner. 2/4 https://www.mhc.tn.gov.in/judis Crl.O.P.No.18997 of 2026 5.
